GURGAON: Amid reports of economic slowdown, Haryana cleared 19 proposals for allotment of land for Rs 2,000 crore worth of projects for top MNCs and Indian corporates on Monday. About 26 acres land has been allotted to Pepsico India at Barwala/ Manakpur for setting up a bottling unit for non-alcoholic beverages. The project would be set up on 40 acres and involve a capital layout of Rs 1,000 crore.

Gurgaon: The National Highways Authority of India (NHAI) seems to have decided to cancel the agreement with private developer of Delhi-Gurgaon expressway even as the company has not yet submitted its reply. Sources said the NHAI was preparing a contingency plan to take over the e-way and manage toll collection.

A memorandum of understanding (MoU) for operation of Rapid Metro Rail in the city was signed between the ministry of urban development, state government and Delhi Metro Rail Corporation (DMRC) on Thursday. 

"We need to find innovative financial methods either in PPP or fully private mode to fund Metro projects. Haryana has taken the first step in giving a Metro project to a private company," said Kamal Nath, urban development minister. 

RMGL is developing a 5-km metro rail link between Sikanderpur metro station and Cyber City at a cost of Rs 1,088 crore. The project is designed for a daily capacity of 2 lakh passengers. The concession agreement for the project was signed in December 2009 and construction started in July 2010. With about 40% of the civil work already completed, the rolling stock is likely to reach the site by May 2012.

RMGL plans to do testing and commissioning by May 2012 before the scheduled launch in March 2013. Haryana chief minister Bhupinder Singh Hooda said plans were afoot to expand the private Metro network to 20km in Gurgaon. The state has already planned for the north-south extensions for the project - about 7km in each direction. The detailed project report (DPR) for the extensions is being prepared and the tenders may be floated soon. This is the first private initiative in India.

The Govt. has made it mandatory for developers to build and provide flats to EWS people at subsidized rates. The draw of lots for allotment of EWS flats was held at Sector 24, Dharuhera, Distt. Rewari on 03/08/2011. The town and country planning department (T&CP) administered allotment of Economically Weaker Sections (EWS) flats in Aravali Heights being constructed by the developer named Dwarkadhis Projects Pvt. Ltd.

EWS flats were solely for BPL families in Dharuhera. However, even the people from economically weaker sections of society from other districts were also eligible to apply Distt. Rewari & Haryana.

Mr. Yusuf (STP, Gurgaon) along with Mr. Arvind Sharma (SDM, Rewari), Ms. Sunita Sethi (DTP (HQ), Chandigarh), Ms. Madhusmita Moitra (DTP, Rewari) and Mr. Naurang Rai (NayabTehsildar, Dharuhera) were present for the Draw.

177 valid* Applications were received against 130 EWS flats. 27, 39 & 64 flats were allotted to the EWS people of Dharuhera Urban Estate, Distt. Rewari & all over Haryana, respectively. A waiting list of approximately 25% of the total number of flats available for allotment was also prepared at the time of the draw so that if some allottees are unable to remove the deficiencies in their applications, the waitlisted persons could be considered.

Note: * Subject to Verification of BPL No. and all T&Cs under the new EWS Policy laid by the Concerned authority.

Service Tax on Construction of Residential Complex

& other Services by Builders- Important Provisions

1.       Service Tax has been levied by Finance Bill 2010 on construction of a residential complex by builders- Clause (II) (5)

2.       Service Tax has been levied by Finance Bill 2010 on PLC, EDC, IDC on construction of residential complex by builders- Clause (I) (6)

3.       Provisions of Finance Bill has been came into effect from 01.07.2010 vide Notification No. 24/2010-Service Tax dated 22^nd June 2010

4.       Service Tax would be leviable @ 10.30% on the 25% value of the gross amount charged for sale of residential complex from the buyers by the builders vide Notification No. 29/2010-Service Tax dated 22^nd June 2010.

5.       Service Tax would be leviable @ 10.30% on the full value charged towards PLC, EDC and IDC. As no exemption has been granted therefore general rate of service Tax @ 10.30% would be leviable.

6.       Service Tax will be collected from the buyers on payment received on or after 1^st July 2010 vide Notification No. 36/2010-Service Tax dated 28^th June 2010.               (Annexure-D attached)

7.       Service Tax @ 10.30% on Club Membership is already applicable w.e.f. 16.06.2005 and service tax will be collected at the time of receiving of Club Membership Fees.

Notification No. 36/2010 - Service Tax

            G.S.R.    (E).- In exercise of the powers conferred by sub-section (1) of section 93 of the Finance Act, 1994 (32 of 1994) (hereinafter referred to as the Finance Act), the Central Government, on being satisfied that it is necessary in the public interest so to do, hereby exempts the taxable services specified in clause (A) of section 76 of the Finance Act, 2010 (14 of 2010) other than services referred to in clause (zzc) and (zzzz) of sub-section (105) of section 65 of the Finance Act from so much of the service tax leviable thereon under section 66 of the Finance Act as is in excess of the service tax calculated on a value which is equivalent to the amount of advance payment received before the said appointed date.

Explanation.-  For the purpose of this notification,

            (i)         “Appointed date” means the 1^st day of July, 2010;

            (ii)         “Advance payment” means consideration received for the said taxable services to be provided.

2.         This notification shall come into force on the date of its publication in the Official Gazette.
